January 13th, 2022:
Covid-19 Update - Employers with 100 or more employees are not forced to mandate vaccination or weekly testing.
The supreme court has reversed the OSHA vaccine mandate for large businesses.

On January 13th, 2022, the U.S. Supreme Court blocked the OSHA Emergency Temporary Standard (“ETS”), which had required employers with 100 or more employees to, among other things, mandate vaccinations or implement a mask and testing policy for unvaccinated workers.

Litigation has been fast and furious on the federal vaccine mandates.

OSHA ETS for Employers with 100+ On Again

On December 17, 2021, the hold on the OSHA emergency temporary standard that requires mandatory vaccinations or weekly testing for employers with 100 or more employees was lifted. An appeal has already been filed with the Supreme Court, and a Supreme Court decision is expected by January 7, 2022.

The ETS deadline for affected employers in states under the federal OSHA jurisdiction is January 4, 2022, and 15 days later for those states with their own OSHA entity. However, OSHA has announced that it will not issue citations for noncompliance before January 10, 2022. The agency also stated it would exercise its discretion and not issue citations for noncompliance with testing requirements under the ETS before February 9, 2022, as long as an employer exercises reasonable, good faith efforts to comply with the standard.

Federal Contractor Vaccine Mandate Still on Hold
As of December 20, 2021, federal contractor vaccine mandate enforcement is still on hold.
